1. Acceptance of Terms

By accessing, browsing, registering for, or using yourkindnesscorner.com (the "Site"), including any community features, forums, profiles, Verified Impact Passport features, pages, groups, events, volunteer opportunities, shops, applications, tools, or other services offered through the Site (collectively, the "Services"), you agree to be bound by these Terms of Service (the "Terms").

These Terms constitute an agreement between you and Your Kindness Corner Inc. ("Your Kindness Corner," "YKC," "we," "us," or "our").

Your use of the Services is also subject to policies and guidelines made available through YKC, including our:

  • Privacy Policy
  • Cookie Policy
  • Community Standards or Guidelines
  • Additional terms presented in connection with particular Services or Paid Services

If you do not agree to these Terms, you must not use the Services.

2. Minimum Age and Eligibility

YKC is intended for users 13 years of age or older.

By creating an account or using Services that require registration, you represent that:

  • You are at least 13 years old
  • Information you provide regarding your eligibility is accurate
  • Your use of YKC is permitted under applicable law

Users under 13 are not permitted to create a standard YKC account.

If YKC becomes aware that an account belongs to a child under 13 in circumstances where collection of personal information is not permitted, we may suspend or delete the account and take reasonable steps to remove associated personal information.

Certain Services or transactions may have additional age requirements.

3. Registration and Individual Accounts

Certain Services require an individual YKC account.

You agree to provide accurate, current, and complete registration information and to update that information where necessary.

Personal member accounts are intended for individual use.

You are responsible for:

  • Protecting your login credentials
  • Activity performed through your account
  • Keeping account information reasonably accurate
  • Promptly reporting suspected unauthorized access
  • You may not:
  • Share an individual account between multiple people
  • Impersonate another person
  • Create an account using a false or misleading identity
  • Use another person's account without authorization

YKC may suspend or restrict accounts that reasonably appear to violate these requirements.

4. Account Security

YKC uses reasonable administrative, technical, and organizational safeguards designed to protect accounts, information, and the Services.

However, no online system can guarantee absolute security.

You are responsible for using reasonable precautions to protect your credentials and devices.

If you believe your account has been compromised, please contact YKC promptly.

5. Member Profiles

YKC is a community platform, and certain profile information may be visible to other members or the public depending on the feature and available privacy settings.

You are responsible for the information you choose to make available through your profile.

You should not publish information that you do not want others to view.

YKC may provide different visibility settings for certain information or Services.

6. Business, Nonprofit, and Organization Pages

Eligible users may create or administer Business, Nonprofit, or other Organization Pages.

A person administering a Page represents that they have appropriate authority or permission to act on behalf of the applicable business or organization.

Page administrators are responsible for:

  • Maintaining accurate Page information
  • Using Page management privileges appropriately
  • Ensuring content posted on behalf of the Page is authorized
  • Managing administrator access responsibly

Organization-owned content and records may remain associated with the applicable Page even if the individual administrator who created or managed the content later leaves YKC.

YKC may require administrator reassignment before allowing a sole Page administrator to permanently delete their personal account.

7. Groups and Community Features

Members may be able to create, join, manage, or participate in Groups and other community features.

Group administrators and moderators are responsible for exercising their permissions appropriately and complying with YKC Community Standards.

If a member is the sole administrator of an active Group, YKC may require that management be transferred to another eligible member or that the Group be closed before the member permanently deletes their account.

YKC may suspend, archive, restrict, or remove Groups that:

  • Violate these Terms
  • Violate Community Standards
  • Are abandoned or unmanaged
  • Present security, fraud, legal, or community-safety concerns

8. Community Standards and Acceptable Use

You agree to use YKC responsibly and in accordance with applicable Community Standards and Guidelines.

You must not use YKC to:

  • Violate applicable law
  • Harass, threaten, abuse, or exploit others
  • Promote hatred, discrimination, or violence
  • Engage in fraud or deceptive conduct
  • Impersonate another person or organization
  • Upload malware or malicious code
  • Interfere with YKC systems or security
  • Attempt unauthorized access to accounts or data
  • Infringe intellectual property rights
  • Violate another person's privacy rights
  • Collect personal information unlawfully
  • Use automated systems to scrape or misuse the Services without authorization
  • Misrepresent community participation, volunteer activity, achievements, or verified impact

YKC may take appropriate enforcement action, including:

  • Content removal
  • Feature restriction
  • Suspension
  • Account termination
  • Page or Group restrictions

where we reasonably determine that these Terms or applicable policies have been violated.

9. User Content

9.1 Ownership

You retain ownership of content you submit through your personal account, subject to these Terms.

9.2 Permission to Operate YKC

By submitting content to YKC, you grant YKC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, process, and distribute that content as reasonably necessary to:

  • Operate the Services
  • Display content according to your actions and settings
  • Maintain platform functionality
  • Provide community features
  • Protect, maintain, and improve the Services

Where content is intentionally made public, YKC may display that content publicly through the applicable Service.

9.3 Responsibility

You are responsible for content you submit and represent that:

  • You have the right to submit it
  • It does not knowingly violate applicable law
  • It does not infringe another person's rights

10. Personal Content Following Account Deletion

When you permanently delete your personal YKC account, YKC may remove personal content associated with your account, including personal:

  • Posts
  • Comments
  • Replies
  • Stories
  • Profile information
  • Personal media
  • Connections

Certain information may be treated differently where it forms part of an organization-owned record, another person's legitimate record, a financial or transaction record, or verified historical community-impact information.

11. Organization-Owned Content

Content created by a member while acting on behalf of a Business, Nonprofit, Organization Page, or other authorized entity may be considered content of that Page or organization rather than solely personal content of the individual administrator.

This may include:

  • Page posts
  • Events
  • Volunteer opportunities
  • Resources and articles
  • Shop products
  • Promotions
  • Community-impact records
  • Other Page-managed content

Such content may remain after the individual administrator's personal YKC account is deleted or their Page access ends.

12. Verified Impact Passport and Contribution Records

YKC provides features designed to record, organize, recognize, or verify community participation and contributions.

These may include:

  • Volunteer hours
  • Community activities
  • Participation records
  • Achievements
  • Verified contributions
  • Recognition
  • Kindness Points
  • Related community-impact records

Users must not knowingly submit false, misleading, fabricated, or materially inaccurate contribution information.

Organizations and authorized verifiers are responsible for using reasonable care when confirming contributions.

YKC may:

  • Review disputed records
  • Correct or invalidate inaccurate records
  • Restrict verification privileges
  • Investigate suspected misuse

YKC does not guarantee that every contribution record has been independently investigated by YKC.

13. Historical Community Impact

Verified contribution information may contribute to:

  • A member's Verified Impact Passport
  • Business or Nonprofit impact records
  • Event results
  • Volunteer history
  • Organization reporting
  • Aggregate YKC community-impact totals

Permanent deletion of a personal account does not necessarily require deletion of a valid historical contribution.

Where appropriate, YKC may retain the underlying verified contribution while removing or anonymizing unnecessary personal identification in accordance with the Privacy Policy.

This allows legitimate historical organizational and community-impact information to remain accurate.

14. Kindness Points and Recognition

YKC may provide points, rankings, recognition, awards, or similar community features.

These features:

  • Have no guaranteed monetary value unless expressly stated
  • May be modified or discontinued
  • May be subject to eligibility requirements
  • May be corrected where activity was improperly recorded
  • May be removed where fraud, manipulation, or misuse is identified

Permanent deletion of an account ends future participation in active member leaderboards or recognition programs.

Underlying legitimate community-impact activity may remain within historical or aggregate records.

15. Events and Volunteer Opportunities

YKC may enable businesses, nonprofits, organizations, or members to create Events and Volunteer Opportunities.

YKC generally provides the platform through which those opportunities may be listed or managed.

Unless expressly stated otherwise, YKC is not the organizer, employer, supervisor, or operator of third-party Events or Volunteer Opportunities.

Organizations offering opportunities are responsible for:

  • Accuracy of listings
  • Volunteer selection
  • Scheduling
  • Supervision
  • Safety requirements
  • Legal or regulatory requirements applicable to the opportunity

Members are responsible for determining whether an opportunity is suitable for them.

16. Verification of Volunteer Hours and Contributions

YKC may permit community organizations or authorized individuals to approve or verify volunteer hours and other contributions.

Verification indicates that the contribution was confirmed through the applicable YKC process.

Verification does not necessarily constitute independent certification, professional accreditation, employment verification, or governmental verification.

Members and organizations remain responsible for the accuracy of information they submit or approve.

17. Paid Services

Certain YKC Services may require payment, including memberships, subscriptions, upgrades, products, passes, or other Paid Services.

By purchasing a Paid Service, you agree to:

  • Pay the applicable price
  • Pay applicable taxes
  • Provide accurate billing information
  • Comply with any additional terms shown at purchase
  • Prices, features, promotions, and benefits may change.

Any recurring billing terms will be presented in connection with the applicable Paid Service.

18. Payments and Third-Party Payment Processing

Payments may be processed through third-party payment providers.

Those providers may have their own terms, privacy practices, and account requirements.

YKC generally does not directly store full payment-card details.

Transaction records may be retained where reasonably required for:

  • Accounting
  • Taxes
  • Refunds
  • Chargebacks
  • Fraud prevention
  • Legal compliance
  • Customer support

19. Third-Party Services

YKC may integrate with or provide access to third-party services, including services relating to:

  • Payments
  • Identity-related services
  • Benefits
  • Discounts
  • Fundraising
  • Shops
  • Communications
  • Mapping
  • Analytics
  • Other platform functionality
  • Third-party services may be governed by separate terms and privacy policies.

YKC is not responsible for third-party products, services, systems, availability, or conduct except where applicable law provides otherwise.

YKC may contain links to external websites or resources.

Providing a link does not necessarily mean that YKC endorses or controls the linked website.

Use of third-party websites is subject to their own terms, policies, and practices.

21. Intellectual Property

The YKC platform and its proprietary materials, including software, designs, logos, trademarks, text, graphics, branding, and platform functionality, are owned by or licensed to Your Kindness Corner Inc.

You may use YKC only for purposes permitted by these Terms.

You may not, without authorization:

  • Copy or commercially exploit proprietary YKC materials
  • Reverse engineer protected software except where legally permitted
  • Use YKC branding in a misleading manner
  • Suggest an affiliation or endorsement that does not exist

22. Account Deactivation and Permanent Deletion

Where available, members may deactivate or permanently delete their personal account.

Deactivation

Deactivation may temporarily hide or restrict an account while preserving information necessary for later reactivation.

Permanent Deletion

Permanent deletion removes the member's active account and personal social presence subject to legitimate data-retention requirements.

Before deletion, YKC may require the member to resolve responsibilities associated with:

  • Organization Pages
  • Groups
  • Events
  • Shops
  • Volunteer Opportunities
  • Other managed community assets

23. Suspension and Termination by YKC

YKC may suspend, restrict, or terminate access where reasonably necessary because of:

  • Violation of these Terms
  • Fraud or suspected fraud
  • Platform abuse
  • Security concerns
  • Misrepresentation
  • Harm to other users
  • Legal requirements
  • Misuse of verification or community-impact systems

Where appropriate, YKC may remove related content or restrict particular platform features instead of terminating the entire account.

24. Privacy

Our Privacy Policy explains how YKC collects, uses, discloses, stores, retains, safeguards, and manages personal information.

Privacy rights and requirements may differ depending on where you reside.

YKC manages personal information in accordance with privacy laws applicable to YKC and the relevant circumstances.

25. Cookies and Similar Technologies

Our Cookie Policy explains how YKC and certain service providers may use cookies and similar technologies.

Where required by applicable law, YKC will provide choices relating to non-essential cookies and tracking technologies.

Users may be able to manage these choices through YKC's Cookie Preferences tools.

26. Marketing Communications

YKC may send promotional or marketing communications where permitted by applicable law.

Where required, YKC will provide:

27. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site and Services are provided on an "as is" and "as available" basis.

YKC does not guarantee that:

  • The Services will always be available
  • All content will be error-free
  • Every third-party listing or opportunity will be accurate
  • Every member or organization will perform as expected
  • The Services will be completely free from technical issues or harmful components

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

28. Limitation of Liability

To the maximum extent permitted by applicable law, Your Kindness Corner Inc. will not be liable for indirect, incidental, special, exemplary, or consequential damages resulting from your use of or inability to use the Services.

Nothing in these Terms limits liability where such limitation is prohibited by law.

29. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Your Kindness Corner Inc., its directors, officers, employees, agents, and affiliates from claims, losses, liabilities, or expenses arising from:

  • Your misuse of the Services
  • Your violation of these Terms
  • Content you submit
  • Your infringement of another person's rights

30. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law principles.

Nothing in these Terms removes rights or protections that applicable law requires to apply based on your place of residence.

31. Dispute Resolution

To the extent permitted by applicable law, disputes relating to these Terms or the Services may be resolved through negotiation, mediation, arbitration, or other legally available dispute-resolution procedures.

Any requirement for arbitration or a particular jurisdiction applies only to the extent enforceable under applicable law.

Nothing prevents either party from seeking urgent injunctive or equitable relief where legally appropriate.

32. Changes to the Services

YKC is continually developing its Services.

We may:

  • Add new features
  • Change existing features
  • Remove features
  • Modify eligibility requirements
  • Change available Services
  • Update pricing or Paid Services
  • Where required, users will receive appropriate notice of material changes.

33. Changes to These Terms

YKC may update these Terms as the Services, laws, technologies, or platform practices change.

The Last Updated date will be revised when changes are made.

Where changes are material, YKC may provide additional notice through:

  • Account notification
  • Email
  • Another reasonable method

Your continued use of YKC after updated Terms become effective constitutes agreement to the revised Terms to the extent permitted by applicable law.

Where affirmative consent is legally required, YKC will obtain it separately.

34. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

35. No Waiver

Failure by YKC to enforce a provision of these Terms does not waive our right to enforce that provision later.

36. Entire Agreement

These Terms, together with the policies and supplemental terms referenced within them, constitute the agreement between you and YKC regarding use of the applicable Services.
